Legal Question in Workers Comp in Georgia
What do I do?
I have been on workers comp for 3 months for a back and neck injury. I got a letter from W/C stating that my benefits were being suspended because thr DR treating my neck said that I was ready to return to work. He is not the DR that put me out of work. I am still having problems with the pinched nerve in my back, including numbness and tingling in my legs. What am I susposed to do the W/C company will not return my calls, and the DR that was treating my back will not do anything for me. I live in pain everyday and this injury has affected my marriage and my whole life. I am looking for my employer to call anyday and ask why, if I can return to work, I haven't. I can't at this point and time. What am I to do?????

In order to fight the suspension of benefits, you will likely need to file a hearing request with the State Board of Workers� Compensation by completing a Form WC-14 (which you can find at the State Board�s web site). You can fight the suspension for several reasons. Did the treating doctor release you to REGULAR duty or to light duty? If light duty, then the employer/insurer must offer you light duty work before suspending your benefits. You can also argue that the doctor that originally took you out of work is your �authorized treating physician� and unless that doctor has released you, then the insurer improperly suspended your benefits. Even if both of your doctors have released you to regular duty, you have a right to an IME (independent medical examination) paid for by your Employer/Insurer. If the IME doctor says that you still have restrictions and limitations, you can use that to argue a reinstatement of benefits. Good luck.
