Legal Question in Workers Comp in Georgia

workmans comp

I work for trucking company. I am a independent contractor/owner operator. They are taking out my check for workers comp and I thought since I am a independent contractor they should not take out money for that.

If you do not have personal disability insurance that pays you as much as you would receive under workers' compensation coverage, you would be foolish to tell your company to stop withholding money for coverage. If you sustain an injury on the job, 100% of your medical bills, including all testing, would be the responsibility of the insurance company. Certainly, there is a downside to the WC system. The employer/insurer controls your medical care. But if you have no alternative source of receiving disability benefits if you were hurt while driving or lifting/pulling any load of merchandise (you could receive as much as $500 per week while disabled) you should keep the WC coverage afforded by your employer.
