Legal Surname

My daughter is pregnant and unmarried. Whose last name will be used by the baby? If my daughter and her boyfriend (who is the father of the child) marry at a later date, will he have to adopt the child to be the legal father?

Your Daughter has a choice of last names to give the baby- hers or the father's-- it can be changed latter. Regardless of whether they marry he will be the legally the father. Depending on his atttitude he may may be willing to admit his patertinity or she may may need to file a claim for paternity. The easiest way may be to see your Court Assitance Office at your county courthouse. The sooner this is done the earlier that he can be be required to provide child support
