school hiring process of a minor

my 17 yr old son, who already works as a janitor at our school thru a special ed program put in an application for summer job thru the school itself. He is a special education student. Today he was told he did not get the job because they said they lost his application this is a very small school district, only one high school, where they took the apps from. He then was told when he asked if he could fill out another app that wasn't needed since they hired already and they would move him up to the top of the list if someone couldn't work...could this be a discrimination case...

Yes, if there is evidence it was due to his disability...right now, it looks like more of an assumption or presumption, but if you take tehe facts to a local attorney, there may be history here or other factors that make it look more like discrimination and less like a job opp gone.
