After Divorce

Can my ex wife file bankruptcy on a debt in our divorce? In lieu of child support she was to pay a loan that was in both of our names and she is filing against it. Also, after we were divorced she opened two credit cards as a joint account with my name without my knowledge and both are coming after me also..she is also filing these in her bankruptcy..will these then be my responsibility even though I had no knowledge of them? These are all now on my credit report.

In answer to your first question, an individual can file bankruptcy on any debt she owes unless it is determined to be non-dischargeable. For example, if your wife owes child support, then that debt is non-dischargeable.

In answer to your second question, if your wife fraudulently added your name to the account, then that is a whole other matter. What were the circumstances regarding these cards? Where is she in the bankruptcy proceedings?
