Legal Question in Bankruptcy in Illinois

Future Lawsuit Help

I was in a auto accident and realized

I was late on my insurance auto

payment. The insurance co. would

not cover the accident and I then

have received letters from the other

party involved and their insurance

company that they are sueing that I

or am responsible for any result of

the accident. I am getting ready to

file bankruptcy, but do not know if I

should wait for a lawsuit first or

putting the ticket and letters that I

have in my petition will cover the

future lawsuits coming against me

within the next two years?

If you are able to identify the parties potentially bringing the claim, you would be wise to include it in the bankruptcy. If not, you run the risk of it maturing into a debt not discharged in the bankruptcy (eg, you would have to pay it). Feel free to contact me with any additional questions.

If you know the parties involved in the auto collision, you could file a BK petition now.
