Accussed of misconduct connected w/work...

I was recently tapped on the shoulder at work and was told that they had to let me go. The company has been talking about downsizing to save money. They offered me a severance and told me to file for unemployment. Now they are fighting that stating misconduct. Do you think I have a case considering all of the above?

Do you have any documentation to support your version of things? Did you have any history of being reprimanded for anything prior to your termination? Did anyone (presumably you talked to someone from IDES) tell you what it was you allegedly did that resulted in your termination? Do you have any witnesses that could support your version of events? Did you ask for a hearing from IDES? Does your former employer have an employee file for you? You need to request it and see what's in it.

Based on the information provided, it sounds like you may have a case. Companies do not usually provide severence when they discharge someone for msconduct.
