Legal Question in Business Law in Illinois

Registered Corporate name challenge

A Massachusetts-based corporation, not registered as a foreign corporation in Illinois, has challenged our domestically registered corporate name, saying they are a 'national corporation'. As infrared inspection service organizations, both businesses can travel to other states to do business. They have been in business for 20 years in the same field our company is in, but do little to no business in Illinois. The owner of the MA-based company called our company president and demanded our corporation change its name because the first word is the same in both. There is another corporation registered in Illinois with the same first word in the name, and several businesses in other states which also use the same first word in their names. Do we have any obligation to change our name?

Re: Registered Corporate name challenge

Hello. In my opinion you are

not obligated to change your

name. This sounds like an

industry intimidation tactic

on the part of the other company to force you from competition. The other company may file a lawsuit,

but you can fight them then.

Right now, I suggests keeping

your name.
