Legal Question in Consumer Law in Illinois

statute on collecting utility bill

in 2001 before my daughter left college, she called the phone co & told them she was moving & to take the service out of her name. in 2004 when she was buying her house, there was a collection from them on her credit report, even though she had never received a bill. she contacted them & they could not get her itemization, so she got her loan. just recently, she got a collection letter & itemization to her home & sent them $50 .... was there and is there a statute of limitations on this? we know that since the utility was in her name, she would have to sue her roommates. she has no written proof of calling them, the bill is over $500 and we are in illinois

Re: statute on collecting utility bill

the statute of limitations is 5 years on a nonwritten debt and 10 years on a written debt.

She owes the money, but could probably negotiate a lower amount.
