Billing me for services

Back in 2004 our trash service was cut off they said we didnt pay are bill, they turned us over to a collection agency and we proved we had payed are bill and they started to pick up our trash again. They never billed us again till just now and they want a years worth of money. They will sue if we dont pay do they have a case. They admitted in writting that they hadnt billed us since 2004 it was there mistake. We they win if they sue us?

They'll probably win. If the grocery store forgets to charge you for a case of beer, it doesn't mean you don't owe the money. This is similar. The fact that they waited a year makes it hard on you, but that one year will probably not bar their claim.

Why don't you call them and ask that, in light of the fact that they have just hit you with a HUGE bill, they agree to let you pay the regular bill as it comes and to pay an additional $50 per month (or whatever you can afford) until you are caught up. Nobody wants a lawsuit. They are expensive and time-consuming.

There should be a reasonable solution to this. Give them a call. Work with them, don't fight them.
