Legal Question in Credit and Debt Law in Illinois

Unauthorized Bank Withdrawal

I let my sister-in-law use my bank

account for a one time satellite

installation fee. I explained it was a

one time payment. They withdrew

695.00 from my account, put it back

but are now refusing to pay my

charges they said they would. What

can i do?

Re: Unauthorized Bank Withdrawal

I am not sure I understand. You loaned your sister in law some money, and she paid it back to you. Or did she take more than she was supposed to take? Now it looks like you want to collect interest. You can certainly sue her for the interest she owes you. Unless you have a written agreement, you will probably only get statutory interest, if that. Right now, I think that would amount to about $20 per year.

I was told once that whenever you loan money to family or friends, you need to consider it a gift. Then you can be pleasantly surprised if you actually do get your money back from them. Count yourself fortunate that you actually were repaid.
