Legal Question in Criminal Law in Illinois

Class 2 felony

I was wondering....If someone is caught with canabis and is charged with intent to sell with 30 grams or more then its a class 3 felony. If it is in 1000 feet of school grounds it is a class 2 felony. Now my question is would a student with great academic standing and no prior convictions of any form face any jail time if convicted of a class 2 felony for intent to sell canabis?

Re: Class 2 felony

There are a number of factors to be considered by the court in determining an appropriate sentence. Sentences to confinement are generally limited to instances where confinement is necessary to protect the public or not sentencing the defendant to confinement would diminish the seriousness of the offense. Sentencing is very case and defendant specific.
