previous employer defaming me

My previous employer called my present employer and told them that I was let go for suspicion of theft....which is untrue, I was let go due violating company policy. I called my previous supervisor and he told me that all he would tell anyone that called him for reference information was my position and dates of work. My new boss called me to let me know that someone did call him but that when he asked specific questions, they said nothing could be substantiated...but they just thought he should know...he brought it to my attention because he didn't feel it was proper or legal for my previous employer to call and give this type of information out. What legal recourse, if any, do I have?

If you have not actually been harmed -- not too much you can do about it. In theory being accused of theft will get you into court -- but with almost no damages it is hardly worth it. Get a lawyer to send the SOB a "cease & desist" and move on.

However, if he has called others and you can show actual damage thats a different story
