Legal Question in DUI Law in Illinois

23 Years Without a License

A friend of mine was arrested twice within a month in 1984 for DUI. He was convicted of one and aquitted of the other. He is not now nor has he ever been a drinker. He made the mistake of turning in the local chief of police for drunk driving and was set up (and we have the Federal Court Docs to prove it). He has tried six times to regain his license and, even though he has had four sepaprate psychologists attest that he is not prone to drinking, he has submitted 30 affadavits from people across the world who know him and swear they have never seen him drink and has presented the Federal Court documents, he has been unsuccessful in even getting a restricted driver's license. We have written to both the Illinois Secretary of State and the Illinois Attorney General to no avail. Is there anything else we can try?

Re: 23 Years Without a License

You might want to try a suit for declaratory judgment. That would be very expensive, but you would have the courts declare your rights and order the Secretary of State to issue the license. Please call for a free consultation.

Re: 23 Years Without a License

Secretary of State has stated on the record why he is ineligible. This need to be addressed or appealed to the Circuit Court. He really need a lawyer to help him with this.
