Legal Question in DUI Law in Illinois

DUI In a Parking Lot

I recently was arrested in a public parking lot for a DUI. Does it matter that I was on private property regarding the penalties that I am facing?

Does the Illinois definition of ''Highway'' or ''Public Roads'' also define a parking lot as such?

Re: DUI In a Parking Lot

For purposes of the DUI arrest, a "person shall not . . . be in actual physical control of any vehicle with this State while:" under the influence of alcohol.

You can be charged with DUI even on private property.
