second dui in 3years

I was put on supervision no con viction 3 years in cook county il.I got arrested oct. 9 2007 in chicago will I be possibly convicted .I refused to take the breath test

There is a strong possibility that the State may not be able to prove the case beyond a reasonable duobt without a breath test. There is new law out of the Supreme Court of Illinois that could negate the Horizontal Gaze Nistagmus test. That's the test where the police officer has you follow his pen with your eyes. It's important to contest your summary suspension as a refusal to blow within 5 years of a previous summary suspension can result in a license suspension of 3 years with no driving relief.
