Legal Question in DUI Law in Illinois

Left the state

My boyfriend has fled his warrent in IL, i think. He was convicted of a DUI some time ago, attended treatment, but has moved to OK with out telling his probation officer. He was also caught shoplifting a year ago and we are recieving bills for fees, and threats of civil action.

He's finaly desided to be a grown up now, and wants to take care of these matters, but we don't know how to do that with out him being arrested.

Is it possible to clear up these matters with out jail time?

You didn't state in what county these charges are pending. The resolution of the charges are somewhat controlled by the local practice. E.g., in Cook County, lots of folks skedaddle, but when they come back because they have grown up or what not, it's not a big deal. In contrast, in Du Page or Kane Counties, the issues extant become more problematic. While no one can guarantee no jail time, I would opine BASED ON THE FACTS YOU PROVIDED, that it is somewhat unlikely.

I practice in the Chicago Metropolitan Area; if your case is pending in Cook or in a collar county, I would like to speak with you regarding the possibility of taking your case for a fee.

Re: Left the state

It is difficult to tell whether or not jail can be avoided based on the information given.

In certain instances, jail can be avoided if he is able to post the bond on the warrant. In this situation, a new court date would be issued by the judge. At that time, the State can file a petition to revoke, if they have not already done so. On a later date, there will be a hearing on that to determine what other penalties, including jail, are appropriate.

I represent clients in central Illinois, and would be happy to take your case for a fee. My website is www.getgramm.com, and I can be reached by phone at 309-275-6677.
