Legal Question in DUI Law in Illinois

question

I have a DUI case from 1996 in dupage county in 2002 I got 2 yrs supervision and some fines. I lost my job and could not pay the fines. How do I clear this up now that my 2yrs has pasted. I now have a job where I can pay the fines.

It would be unusual if your case was terminated without your fines being paid. It is more likely that the State's Attorney's office filed a petition to revoke your supervision based upon your failure to pay the fines. When such a petition is filed, the case continues until the petition is resolved. In the case of a DUI, it is possible that your supervision would be revoked and a conviction would be entered.

If that were to happen, your driving privileges would be revoked, that is your driver's license would be no good, and you could go to jail simply for driving. In DuPage County, it is highly likely that a warrant would be issued for your arrest. In the event that is the case, you can be picked up and brought to court for failing to pay the fines. You are best to have the assistance of counsel when attempting to resolve this matter, as a misstep can cost you not only jail, but your driving privileges as well. The first thing you need to do is find out what the status of the case is. Did the Social Services file a petition to revoke supervision and then did theCourt issue a warrant for your arrest. The clerk of the court will give you the status of the case.

I practice in Du Page County. The intitial thing that you would want to do is to see if the prosecuting attorney filed a "PTR" (Petition to Revoke)and to otherwise determine the status of the case. That will point you in the direction of what kind of motion you would wish to file to resolve this case.
