Legal Question in Family Law in Illinois

Adoption in the State of Illinois.

My daughter is being married in March, 2007 and has a 4-year-old son who has never been supported by his biological father, who happens to also have a lengthy police record, including pending trial for aggrevated criminal sexual abuse of a 15-year-old girl (he's 32). Her fiance, who has been an active part of her son's life for the past 3 years, would like to adopt her son after they are married. What are the laws regarding the ''biological'' father's rights? Thank you.

Re: Adoption in the State of Illinois.

Hello. Biological dad must receive notice of the adoption proceedings.

If he chooses to answer, he can. Your daughter's husband's petition should argue that biological dad abandoned and/or neglected the child.

Will be happy to discuss this further and in more detail.
