Legal Question in Family Law in Illinois

Currently we revolve around my ex-wives work schedule as a nurse. She makes it herself and its never consistent. I have the children the night before a day that she works and through that day plus every other weekend like normal. Some weeks I am dropping them off one night and picking them up again the next night. The next week I may have them 4 days in a row then they go with her 6 days in a row. The kids are confused. I'm confused. What are my chances of getting a real custody schedule set in place from a judge if we went to court over it? It is in the divorce papers that is to be this way. It has been almost 3 years since the divorce was finalized.

Divorce courts "retain jurisdiction" over divorce decrees to make sure they are carried out as intended. But the key here is that you say the kids are confused, and custody issues are supposed to be resolved around what's best for them. Your being confused is most likely irrelevant especially if she was a nurse while you two were married and you should know what a nurse's life is like. So the first place to start is with her because of the kids. If you run into problems that are unreasonable, then you should seek counsel.
