Legal Question in Family Law in Illinois

I have been separated from my husband for almost 8 years now, he is living with someone as well as I, I haven't been able to afford the divorce and he says he can't help either. My father has just passed away and left some money for us kids. Can my husband try to get any of it ? Can I use some of it to obtain the divorce ? He was very abusive,we had no children,land, money etc.

A long as you keep the money in an account in your own name it is non-marital property. you can use it for anything you want, including filing for a divorce. If you have no children and no money, you could discuss with your husband a joint simplified divorce. The court clerk would have all the forms you need.
