Travel vs Custody

is it likely to be denied custody because i am out of town 2 nights a week having a Nanny come in

The judge has to decide what is in the best interests of the child based in part on the family situation prior to the dissolution, as well as the current ability of the parents to provide a home for the child. Being away for two nights a week may impact adversely on the child's care, and again, it may not. The courts are moving more toward the non-custodial parent caring for the child in such situtions - rather than having the custodial parent go the expense of extra child care costs. I would encourage you to discuss this with the child's other parent in order to reach an agreed solution.
