Golf Course Responsibility

While playing golf in a weekly league, I hit an errant shot from the eighth fairway toward the nearby ninth tee. It was a low screamer. I yelled ''fore'' and before they could even react it hit one of the guys in the earlobe. There was a lot of blood. He got a ride into the clubhouse where he sat and collected himself. Later he said his vision wasn't right and ended up being treated for detached retina. The doctor bill was $1200 which his insurance didn't cover. Who is responsible for the cost of the injury?

Your question is a good one. I myself pulled a tee shot a few years ago and broke a windshield on a passing car. Generally, the law is that a person "assumes the risk" of being injured on or near a golf course, at least that is the law in Missouri. I would have to research the current law in Illinois to actually provide you with legal advice. This may only take a half hour to an hour of time. I tend to agree with the position of Mr. Nack that a participant in the game of golf assumes certain risks of such participation, i.e., getting hit with an errant golf ball. However, I do not think you need to spend money at this point to find out the answer to the question.

If you do not want to pay for the medical bill, you could wait until the victim sues you (which, for $1,200, does not seem very likely). If he does, you can conduct the reseach at that time and, if it turns out in your favor, defend the lawsuit to its conclusion or, since it such a low amount, settle the case for the approximate amount that the research would have cost you.

Settling legalities aside, I would probably pay the poor guy's bill -- hell, he got a bleeding head and detached retina from getting hit -- especially if I were faced with expending money to research the issue.
