Re: Joint Credit Card Debt

You can sue an ex partner for debt on a credit card under a theory of oral breach of contract or quasi-contractual relief such as unjust enrichment or quantum meruit. The amount of youe damages is the cost of the goods purchased and any interest accrued. If the matter is under five thousand dollars you can sue in small claims court with or without an attorney. However, if you plan to sue pro se (on your own) I suggest you learn the prima facie elements of what you need to prove to win. Otherwise consult an attorney.
