Legal Question in Civil Litigation in Illinois

my husband lent our vehicle to someone we thought we could trust - she used the car for something other than what she told us (visiting family member in hospital), let someone else drive the vehicle, they crashed my car, injured a pedestrian, and were found to have heroin in their possession. As the vehicle owner I had to pay for the police to release the vehicle ($500) because of the drugs, $400 dollars for the towing and storage fees, and will have to pay $500 deductible for repairs. Do I have any legal recourse such as filing for destruction of property, can I file charges for unauthorized use of my vehicle, or is my only option small claims court to hopefully get restitution for my expenses?

1 Answer from Attorneys

1. Depends on whether you want to file any insurance claim with your own carrier, and whether you have coverage for any of this.

2. Depends on whether the "someone" had insurance and whether any of this is covered.

3. TIME TO GET AN ATTORNEY; this is too complicated and requires too much additional information to be adequately addressed here.
