Legal Question in Civil Litigation in Illinois

I lost my home in a fire dec 19th 2007 after my lawyer told me to no longer insure my home because it was in forclosure he said all i needed was renters insurance, when i called state farm and told them to convert my home owners policy to renters insurance she said it was all set. The day of the fire I called my agent and he said the renters policy never started because I didn't send a check for the first month? they never told me that nore did they send me a letter about this in october of 2007. needless to say I didn't get 1 penny from them and now I can't get renter's insurance because I've had a house fire and have to wait 5 years. does that fall under errors and ommisions ? How come they still had it in their system that i had renters insurance for $250,000!
