Legal Question in Insurance Law in Illinois

Last year[2009] I had an injury of my knee.Went to my Doctor then to a Specialist.I had X-rays on my knee then MRI and THE Specialist even had a date for surgery. After I realize I could not afford this surgery I went to a Lawyer and filled a Work Compensation Claim. The claim was denied after 8 months. My Health Insurance company did not pay the bills till late August 2010.Now my service Provider want me to pay a FINANCE[late] Charges on this bills even it is not MY fault that the Insurance Company did not pay them on time.

Who need to pay for this Finance charges-Me or the Insurance Co.?

It would depend on when you notified your insurer. If you notified them promptly, and they took months and months to get the bill paid, then you have a good point. On the other hand, if they did not get involved until after the workers comp case was denied, then the finance charges are probably not their fault. I recommend you file a complaint with the Illinois Dept. of Insurance to see if they can assist. Good luck.
