Legal Question in Employment Law in Illinois

Loss of commissions due to company neglect

I work as a loan officer for commission and salary. 2 weeks ago we were informed that our company did not renew its license as it should have. It will be at least 2 more weeks before we are able to work. We are still getting salary but no possibility of commission. I drive 3 hours round trip(130 miles)and would not drive that far for hourly wage. They are making us go to the office every day even tho we have nothing to do. I mean there is honestly nothing to do. If we dont then we dont get paid. Since this is due to their neglect shouldnt they have to pay us even if we stay home until we can work? They have already caused us undo hardship by keeping us from commissions. It costs me $100 a week in gas and

tolls. I did not take this job for $11 an hour. Also, one week we had to go to an office in another town for training. It took me 4.5 hours round trip and they will not pay my extra mileage. Is this legal?

Re: Loss of commissions due to company neglect

Unfortunately, unfair may not always be illegal. Do you have an employment contract or an employee handbook? Those two documents may provide further guidance as to the answers to your questions. Without more facts it is difficult to give you a yes or no answer. I would be happy to give you free 1/2 hour consultation to further discuss your situtation.
