Legal Question in Employment Law in Illinois

resume fraud

If an applicant for a position lies on their resume, is this considered fraud. The person in question was granted a particular pay rate based on the education level claimed. However, it has come to light that that level was never attained. Since he has been paid based on that information, and the information is false, does his action constitute fraud?
