Legal Question in Landlord & Tenant Law in Illinois

To whom it may concern,

I moved into my town home in May of 2009. Around August I started getting bites on my arms and legs. At first I thought there was a rouge mosquito in the home. After about a week I was told that it may be bed bugs. I then proceeded to get some information online on how best to find these insects. After a few days I found the evidence I was looking for (fecal stains on the seams on the box spring). I then found a fairly large one and taped it to a piece of paper and showed it to the administration at my complex. They proceeded to bring in exterminators to take care of the issue. The exterminators helped, a lot, but after about 3 to 4 weeks they just stopped coming. The last time they were at my home they told me that I would have to get rid of my bed side tables and either buy a new bed or buy mattress and box spring encasement for the one I have. I have since thrown out the tables and bought the encasement. However the infestation is still a problem. What I want to know is what is my land lords liability? I now have a bed that is ruined, and I'm out two side tables. I'm not looking for 100% compensation, however, I plan to move somewhere else when my lease is up and I am afraid of taking these things with me since they can go 18 months without food. What can I do. Thank you.

Sounds like your basic question has to do with your ruined furniture. If you had renter's insurance the loss may be covered and then the insurance company may be able to sue the landlord to recover what it pays you. But insurance may only pay the "depreciated" current value of the furniture as used furniture. If you don't your only recourse may be to sue, depending on the kind of lease agreement (oral, written..) you had. You should have a lawyer look at your lease agreement and help you with your options. Good luck.
