renters not paying deposit. they signed a 1 yr. lease. they are also trying to pay the rent behind not ahead, how do we get our deposit legally? can we give them a 60 day notice to move? they knew that they had to pay 1 months rent and deposit at lease signing, now there saying it is a complete surprise that they have to pay this, its been 4 weeks. they gave me money at lease signing for rent, my reciept says for rent now there saying that was the deposit. and now ther trying to pay me what they call there 1st. months rent a month later. you always pay rent ahead , not behind. we are working with them to pay the deposit in 4 monthly installments , and they want it in 12 installments. we said no. what if they dont pay the deposit? what steps do we take?? thanks!!!

These people are not worth the trouble in my opinion. You are looking at twelve months of headaches. If your lease requires the security deposit and that rent be paid on the first of the month, give them the appropriate notice and file for eviction. Do not work out any deals, full payment and nothing less.
