i am trying to evict a tenant who does not have a lease how do i evict this tenant who does not have a lease with me?

If this is a month-to-month arrangement, you must give notice at least 30 days prior to the next rent date. So for example if rent was due on the 1st and you want the tenant out August 1st, you're too late now that it's mid-July, but if you give notice now then it would be effective 9/1. Then if the tenant doesn't move you file a forcible entry case. Also, if the tenant does not pay rent for August on the 1st, you can give a 5-day notice and file sooner. If there are additional facts we should know, please let us know, otherwise the answer could change dramatically.
