Legal Question in Landlord & Tenant Law in Illinois

Hello,

I have a tenant that I would like to ask to leave, but am certain that I will be given a very difficult time. There is not lease agreement. I will give 60 or 90-day notice. What are my rights? What are her rights?

Thank you.

Diane

p.s., right now I would like to have free legal advice.

It sounds like she's on a month to month lease, in which case you need to give her a 30 day notice. If she does not vacate the premises after the stated time period, then you need to file an action in court to evict her. If she does not leave volutarily, you need an Order of Possession from the Court to get her out. If you would like to discuss this matter further, feel free to call our office: 773-684-5730.

This reply is limited by the information provided, and does not create an attorney-cleint relationship.
