There are times by using an Order of Protection or as part of a divorce case where one of the spouses might be able to get sole possession but there usually would be some harassment or physical/emotional abuse before that would be ordered.

If he's not on the lease I suppose you could try a lock-out and I don't see how the police or something would see that husband is entitled to live there. I think if you do this you might open yourself up to a crime or actually an Order of Protection against you by the husband.
