Legal Question in Landlord & Tenant Law in Illinois

Termination of Adult Child Living in Home

My mother has a special problem. She and my brother (age 43) agreed to live together and split the bills. No contract or lease agreement was ever signed they just verbally agreed. My father died in 1998. Before his death my parents did not collect any rent from him. After my father death my mother asked him if he wanted to stay in her home he would have to help with expenses. He is currently making $41,000 a year. He has become abusive (verbally and destorying her property) She is now asked him to move. He is refusing to move out. What can she do to remove him from her home? She tried to give him time to move out but he refuses, he feels that her home (only her name is on the deed) is his. Please tell me what she can do about this situtation. Thank you.

Re: Termination of Adult Child Living in Home

Contact the local elderly help lines and have them intervene. Take him to court and evict him. Change the locks! He has no right to remain there and he needs to get out.
