Do I have a Medical Malpractice claim?

I received a Modified McBride/Scarf Bunionectomy bilateral for severe Hallux abductovalgus with bunion formation bilateral on both my right and left foot 5/22/02 by a podiatrist. Something went wrong and on 10/10/02 I had a Reduction Hallux Varus on my right foot. He made me very uncomfortable and was very rude to me from the moment after my first surgery on 5/22/02, I felt like he was taking it out on me because his surgery went bad. It is now a year and a half later and my foot is no better, I'm in constant pain and people make fun of the way it looks. I have all the x-rays, post operative records, and the notes of each apt. I want more than anything to get my foot fixed once in for all, but I also want to be compensated for it, do you think I have a case of Medical Malpractice?

In order to figure out whether you have a malpractice case, a competent physician must look over the medical records and find out whether the treatment you have received lacked the standard of care prescribed for that type of treatment in this community. The fact that you are not 100% in and of itself is not automatically indicative that the doctor did something wrong. You really would be better off getting your medical records to an attorney who practices in that area to have it looked at. It is important that you take the time to do that...
