Pedestrians rights

In a suburban town with no sidewalks, who is liable when there is a pedestrian vs vehicle accident occurs while the pedestrian was walking down the side of the road, and no impairment of drugs or alcohol are involved?

First off, the driver and the owner of the vehicle involved may be held responsible. The pedestrian may also be held responsible so far as he may have been contributorely negligent in placing himself in a hazardous situation. The township or the municipality may also be held liable. That is more tricky since they may be immune from tort liability.
