Settlement for Minor/Child

Our 7 yr old daughter slipped

and fell on a newly mopped

floor at a facility that hosts

birthday partys. She lost

cons for 40 seconds, lost

her vision for over an hour.

She spent the night in

intensive care. She has

suffered memory loss,

nightmares, headaches and

fatique. I am assuming this

will settle out of court (4

witnesses saw employee

mopping, and 2 children,

including mine, fall) and was

wondering if the settlement

received will be put away in a

court appointment account

until my daught is no longer

a minor. How is a cash

award handled when the

person is a minor in IL.?

If the money received is for an amount in excess of $10,000:

1- the probate court has to approve the settlement;

2- once the settlement is approved, your child's share will have to be placed into a probate account for her use when she turns 18,

3- the funds cannot be accessed until the child reaches the age of 18 or by order of the court.

Minor's settlements require court approval to be held until minor reaches 18 or pursuant to court order.
