Legal Question in Personal Injury in Illinois

Sexual assault at work place

I was sexually assaulted by a customer at my place of employment. I informed my employer immediately afterwards and they called the police. The gentleman was arrested. Is there anything else I can do?

Please accept my sympathy for what you have suffered through. There may be a cause of action available to you. However, I have a number of questions and due to the sensitive nature of your situation, this is not the proper place to ask them.

Yes.

As a victim of a crime, you can apply to the Illinois crime victims compensation program - more info can be found at the Illinois Attorney General's website. You do not need an attorney to recover those benefits but they are limited in nature and are designed to compensate you for out-of-pocket type expenses.

You can file a lawsuit against the perpetrator of the crime but the chance of recovery is low, unless the attacker has personal funds to use to pay the judgment and hopefully he will be in jail for the rest of his life but that limits his ability to pay "restitution".

You may be able to file a lawsuit against the owner of the property where the attack occurred, but that is a very fact-specific lawsuit and may not apply to your situation.

Your most likely recovery would be to to file a worker's compensation claim.

You should be entitled to medical benefits, including counseling and mental health experts.

You would be entitled to benefits while you are unable to work and a recovery for your injury, including post traumatic problems, depression, loss of occupation and permanent injury.

These types of injuries are always very tragic and I am sorry you are in this situation.

Best of luck to you.
