Condo Association

My dad has lived in his condo for 28 years. He is now retired, a widower, and living on a fixed income. He fell behind on his assessment fees. My dad has requested a payment plan. The condo assoc. refused. If he pays what he can afford each month in good faith, can the condo assoc. evict him anyway? They want $500 in assessments & $400 in legal fees, which he can't pay in full or even in a few installments.

You can't force the association to accepat a deal, even if it's in their best interest. Tell your Dad to pay what he can, or at least to send them a letter (certified is best) telling them what he can pay and what he has tried to do to cooperate.

This will show good faith in case they try to take him to court. No doubt the judge would view him very favorably if he did that. It seems unlikely that anything harsh would happen to him in that case. But to be safe, you should hire an attorney if they do take him to court. Good luck!

Perhaps your father should look into a reverse mortgage. He would then have funds to pay the assesments.
