Legal Question in Real Estate Law in Illinois

Are we In Danger if we buy this house???

My husband and I have made an offer on a home we want to buy, contingient on the sale of our home. The offer has been accepted but now we are extremely nervous about it as we have learned that the home has tenants with a lease that does not expire until November. Originally the seller told us they were on a month to month lease and she was not going to renew next month. NOw we know this is not true and she has not started eviction procedings yet. The tenants are late with the rent. If we buy this house are we in danger of being landlords to tenants who dont want to move? These tenants have made it known they do not want to move. They do not let perspective buyers on the property too view it. I am afraid this will be a nightmare.

Hello. You are correct in my

opinion. That could be a

nightmare. The tenants need

to be out, before any negotiations on the house continue. Furthermore, I assume that you intend to occupy this home as your principle residence. If my

assumption is correct, the

seller could not deliver the

premises to you on account of

these tenants and as a result

the seller would not be

able to perform under the terms of the contract. It should be the duty of the seller to rid the house of

the tenants. Good Luck!!
