Trying to Evict

The landlord of the building wants to evict our office of the grounds that he made an agreement with someone no longer at the agency. We don't know or can verify - what agreement he is talking about-we have paid our rent every month(we have proof)since 2007 when the new lease came out - all the way up to September 2008. Besides taking our records, any advice?

You didn't say what kind of lease you have. If it is month to month the LL can serve a 30 day notice and evict regardless. If you have a longer term oral lease or a written lease then the Landlord should abide by the terms. If LL is saying that someone employed by the tenant with apparent authority to do so agreed to modify the lease then you will have to raise that as a defense at the trial.

Either way the landlord will have a lot of trouble evicting you if he is not giving you a copy of the agreement. If there is no written agreement and over a year old, its probably not enforceable anyway. You should consider getting an attorney to go through the lease and other records to see where the landlord may have failed to follow proper legal procedures before being able to evict.
