Legal Question in Real Estate Law in Illinois

Fiance and I want to buy a house

He will be putting a $50k down payment. I have nothing to put down but will be paying for half of all the bills. He does not want me on the deed. Can I still be on the deed but have a separate contract written up stating he gets his $50k back and we splilt the remaining equity?

Yes. The default arrangement on home ownership is basically a 50/50 split, but it is definitely possible to arrange for another division in all the necessary documents. You will need probably need an attorney to make sure that everything is filed properly. If you are interested in talking about how to work out the details, please feel free to give us a call and we can set up a meeting.

Certainly nothing wrong with that plan, but I would suggest you have an attorney prepare this agreement for you.

You certainly can have a contract drafted that will protect your interest. Quite frankly, I would question your fiance as to why he does not want you on the deed.

I would be sure to have an attorney draft the appropriate document for you. Do not try this on your own.
