Legal Question in Real Estate Law in Illinois

Home Family contract

My father passed away in 2004 leaving an apt building in trust. However the trust was written incorrect by my fathers lawyer Even the lawyer admitted it was written incorrect the trust had made my step mother as trustee with all power over the building. Our names were removed from the deed also. My brother and I have made all mortgage payment' ins, tax utility payments maintance ect since the building was purchase in 1999.(we all occupied the 3 flat).

my father and step mother contributed $400 per month to help with utility's In 2005 our step mother said she wanted to make it ''right'' so we had an agreement contract written up by a lawyer. she added our names back to the deed of the home. we agreed to let her live there as long as we owned the building. If we sold we would pay her a portion of the sale $60,000. She was informed by our lawyer she may want to get her own lawyer she declined. Now this is my problem. now that part of the agreement is not in her favor( payment for additional occupants in her apartment) She has contacted a lawyer accusing us of elder abuse( she was about 62 yrs old)

and we should void the agreement.

Is this sighed aggrement binding?

Can we lose every thing we put into this property?

Re: Home Family contract

Check with your own lawyer. He would be in the best position to answer since he drafted the contract and hopefully has language that protects you.
