Legal Question in Real Estate Law in Illinois

Quitclaim Deed

My spouse and I divorced. The judge awarded me the house. To remove ex-spouse's name from mortgage, is a Quitclaim Deed what I need to file? The divorce attorney did not take care of this. Thank you for your time.

Yes, BUT...this will not get the spouse off the mortgage. You will need to refinance to accomplish this.

Re: Quitclaim Deed

quitclaim to take him off the deed. But beware, your mortgage will not be controlled by the Quitclaim. Therefore the mortgage will still be in his name also if its in both your names. There are other specifics that i would be happy to speak with you if you want to call me.
