real estate closing mistake

When a mortgage company decides not to allow a name added to a title of a home, who's responsibility is it to tell the buyers ? Is it the closing lawyers or the mortgage company itself ? A family members name was omitted off a title of a home we bought, we were never informed of this before, during or after the closing. It was a last min. decision by the mortgage company, so we're told. Im confused as to how this got past everyone at the closing and is just comming out now. The persons name that was ommitted, was originally in place, but whited out after the closing was over, and in its place over the white out, its handwritten '' in fee simple'' after the other persons name. How can a title company whiteout a name once its in place, and not initial the handwritting that they added ?? My closing lawyer never showed up, she sent a last min. replacement who rushed through everything and never once mentioned that the mortgage company demanded on name be taken off title. I lost the home because of this, because the one person named on title took out a loan, doubled my payment, and the home went into foreclosure because I could not make the payment. My lawyer is denying responsibility and blaming the mortgage company.

You really should find a real estate lawyer in your area and discuss this with him or her. You may have a cause of action here.
