Legal Question in Real Estate Law in Illinois

Residents are storing personal belongings in common elements of our condo association. One such item is a HUGE basketball hoop stand. Who is liable if this falls and damages property or worse yet injures someone? Also, they are using our common driveway as a basketball court. Once again, who is liable for any damages or injuries. Our by-laws state that nothing is to be stored on common elements.

The association would have some liability. the individual owners not involved in storing items in the common area would not be. You should demand that the Association enforce its rules.
