Legal Question in Traffic Law in Illinois

Insurance card

My husband was pulled over yesterday for expired tags. He also did not have the insurance card in the car. Will he be able to just go to court and show them the insurance card?

We had just switched insurance companies and the effective date just happens to be the date of the ticket. Our other insurance expired the day before so there was no lapse in coverage.

Re: Insurance card

Yes, if he actually had insurance prior tofbeing stopped. If it begins on the date of the ticket, prosecutors can become suspicious that someone went and got the insurance right after the ticket. Showing such a card in court is likely a Class A misdemeanor with up to a year in jail. If there is a binder that showed the coverage began at midnight or some time before the ticket, it would be best to bring that to court. If the insurance was actually effective after the time of the ticket, it would be wise to bring it to court, but be honest about it. You might catch a break all together, but at the least the fine will be reduced. If you have further questions, please visit http://shestokas.com/
