Legal Question in Traffic Law in Illinois

Question of responsibility.

On Monday, Dec. 31, 2001, I was southbound on County Farm road. As I approached the intersection of County Farm and St. Charles Rd. the light turned yellow. I looked up at the light, and then looked back down at the road and there was a green van turning left from the on-coming lane in front of me. Before I could hit my bakes, I hit the van. I was traveling at about 45 M.P.H. From what I understand both vehicles were totaled. There was a third vehicle that was hit by flying parts. There were no tickets issued. I talked to an officer at the hospital, who told me that a witness heard my engine speed up. He said it was partly my fault because of this. He also stated that she should have yielded right of way, so she was also partly at fault. We were both taken by ambulance to the hospital. I am not sure what, if any, injuries she received. I have large cut (about 1�) above my left eye, and assorted other bumps and bruises. The problem is that I did not have insurance at the time of the accident. In your professional opinion, is there a chance that I can get her insurance to replace my truck? Every one I have spoken with says she should be solely responsible.

I've practiced law in Du Page County for more than 20 years. So, if you have no insurance, for which you probably received a ticket, you have no insurance company to submit a claim to. You must sue, but please do not try this yourself. You will need competent legal counsel. Good Luck!
