Estate?

My husband passed away in 2007 no will no life insurane no assets over $500. However, 3mths later, his pension plan states that he was owed retropayments and states this amount is payable to his estate (but there is no will), I am confused. the check totals $8,000. I am still recoving from cost out of pocket for funeral expenses, can I pay myself? creditors are sending bills and calling, but there is not enough money to cover his all of his creditors. What do I do?

Your husband's estate needs to be opened, and you appointed administrator. Then any funeral expenses will be paid (or reimbursed), then any legal fees needed to handle the estate, and lastly the creditors. I am simplifying things.
